The New York State Division of Housing and Community Renewal (“DHCR”) has issued a new Renewal Lease form (Form RTP-8 (7/22)) pursuant to RGB Order #53.

New Renewal Lease Form from DHCR

This Rent Stabilized Renewal Lease form should be used for Renewal Leases commencing on or after October 1, 2022.

• Rent Stabilized Apartment Guidelines
  • For a one-year lease commencing on or after October 1, 2022 and on or before September 30, 2023:
    • 3.25%
  • For a two-year lease commencing on or after October 1, 2022 and on or before September 30, 2023:
    • 5.0%

Electronic Lease Offering and
Tenant’s Voluntary Consent

On March 25, 2022, DHCR issued Operational Bulletin 2022-1, providing instructions to allow tenants to voluntarily consent to accept electronic lease offerings.

• Owners are not required to offer leases electronically.
• Owners who choose to offer an electronic lease must obtain the tenant’s voluntary written consent on DHCR’s form HERE
• Owners cannot require a tenant to sign the consent form.
• Each tenant named on the lease (except for spouses or domestic partners) must consent.
